2. About SAYF Australia

SAYF Australia is an Australian-owned business selling personal safety products including personal alarms and related accessories. Our products are designed to assist with personal safety. They are not a substitute for emergency services or professional security advice.

SAYF Australia is not a security company, emergency services provider, or safety equipment manufacturer. We source and sell consumer safety products.

3. Products and Orders

3.1 Product Descriptions

We take care to ensure our product descriptions, specifications, and images are accurate. However, we do not warrant that product descriptions, images, pricing, or other content on our website is complete, reliable, current, or error-free. If a product is not as described, faulty, unsafe, or otherwise fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a repair, replacement, refund, or other remedy under the ACL. Nothing in these Terms limits those rights

Product images are for illustrative purposes and may vary slightly from the actual product. Colours may appear differently depending on your device's display settings.

3.2 Pricing

All prices are displayed in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Prices are subject to change without notice. The price charged for your order will be the price at the time your order is placed and confirmed.

We reserve the right to cancel or modify an order in the event of a pricing error. If this occurs, we will contact you before processing your payment and give you the option to proceed at the corrected price or cancel your order.

3.3 Order Acceptance

Placing an order on our website constitutes an offer to purchase. Your order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, errors in pricing or product information, or unavailability of stock. If we cancel your order after payment has been taken, we will issue a full refund.

3.4 Payment

Payment must be made in full at the time of placing your order. We accept payment methods as displayed at checkout, which may include credit and debit cards and other payment options facilitated by Shopify Payments or other payment processors.

Payment is processed by our third-party payment processors and we do not store your full card details on our systems. All payment processing is subject to the terms and privacy policies of those processors.

3.5 Stock Availability

We make reasonable efforts to display accurate stock information. In the event that an item you have ordered is out of stock after your order is placed, we will contact you as soon as possible to offer you an alternative, a backorder, or a full refund.

4. Shipping and Delivery

We ship to addresses within Australia only. Delivery timeframes are estimates only and we cannot guarantee delivery by a specific date. SAYF Australia is not responsible for delays caused by our delivery partners, customs, or events outside our control.

Risk of loss and title for products passes to you upon delivery to the shipping address you provide. If a delivery fails due to an incorrect address provided by you, you may be responsible for redelivery costs.

5. Important Product Disclaimer - Personal Alarm

PLEASE READ THIS SECTION CAREFULLY.

The SAYF personal alarm is a consumer safety accessory. It is not a substitute for calling emergency services (000) directly.
The 130dB alarm functions as a standalone deterrent and operates independently of any phone or internet connection.
The Bluetooth-enabled features, including the automatic call to 000 and emergency contact notification, require the SAYF to be connected to a compatible smartphone, and the smartphone to be within Bluetooth range and have mobile network coverage. These features will not function if any of these conditions are not met.
SAYF Australia makes no warranty that the Bluetooth features will function in all circumstances or that emergency services will be reached in every instance of activation.
SAYF Australia is not responsible for any loss, injury, or harm arising from reliance on the product's features, including in circumstances where the product does not function as expected due to technical limitations, user error, network failure, or device incompatibility.
You are solely responsible for ensuring the product is set up correctly, maintained in working order, charged up and used appropriately.
This product is not designed for use by children. Keep out of reach of children.

Nothing in this disclaimer limits your rights under the Australian Consumer Law.

6. Intellectual Property

All content on sayfaustralia.com.au, including but not limited to the SAYF name, logo, wordmark, brand elements, website design, text, images, graphics, and product descriptions, is owned by or licensed to SAYF Australia and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, display, or use any of our intellectual property without our prior written consent. You may share our content on social media provided you clearly credit SAYF Australia and do not modify the content in a misleading way.

7. User Conduct

To the maximum extent permitted by law, our website and its content are provided 'as is' and 'as available' without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
